If you’ve been charged or under investigation for a federal offense, a qualified Raleigh federal crimes lawyer at Scharff Law Firm can help. If you end up hiring us to represent you, we will do everything in our power to mitigate the consequences and work hard to make sure your story is told. The laws, the process, and the punishments are very different in federal court than they are in state court. The prosecutors are armed with powerful resources to help create a case against you, even months before you realize you’re being investigated. They may have access to your prior conversations, financial documents, and detailed accounting of your whereabouts via some sort of tracking device.
It’s crucial that you retain a law firm that has the experience and time to devote to your case, in order to combat the seemingly unlimited resources of the Federal Government. At the Scharff Law Firm, we can help.

He has handled matters in every federal district of North Carolina.
Jesse Scharff has been practicing criminal defense since 2003 in various jurisdictions. He is licensed to practice both in Maryland and North Carolina and also in every federal district in North Carolina. He has experience in both the Western and Eastern Districts of North Carolina representing folks charged with federal drug crimes, federal DWI, and child pornography.
Federal Criminal Charges in North Carolina
In North Carolina, federal crimes are charged by either the Western, Middle, or Eastern Districts of the U.S. Attorneys Office. If we are hired early in the process, we can help control whether these charges are implemented by an indictment or an information. The process of indictment consists of the federal prosecutor presenting their case before a grand jury who determines whether there is probable cause sufficient to proceed with the charges. This is a secret process that will happen without your knowledge and can result in an arrest when you’re least expecting it. After being arrested, you would proceed to an initial appearance before a magistrate judge. The magistrate judge will then send your case to a district court judge for hearing and the likelihood of your release pending the next court setting can be very low.
If a Raleigh criminal defense lawyer at Scharff Law Firm can get involved prior to an arrest, we can impact the process by meeting with investigating federal agents or the assigned U.S. Assistant Attorney to propose proceeding by way of an Information. If negotiations are successful at the front end in this way, an Information will often include a charge that you’ve agreed to accept with the option of turning yourself in at a time you feel works. Less surprise for you, and an increased chance of being released at your first appearance pending your District Court Judge appearance because you’ve cooperated from the beginning.
Early Stages of Criminal Representation
If the Scharff Law Firm can get involved at the early stages, we could impact whether or not you’re charged at all. In a worst-case scenario, we could ensure that you’re not over-charged and, as a result, over-punished. This kind of cooperation at the beginning of your proceedings can be very effective in federal court. Call us, so that we can advise you on how to handle potentially speaking with law enforcement or any Federal Government agent. Never speak with law enforcement without consulting with a Raleigh federal crimes lawyer first. While all of this is going on, we will be able to proactively gather evidence that may assist in persuading the Federal Government that your involvement is limited or perhaps even non-existent.
Federal Sentencing Guidelines
Any federal court hearing is important, but having experienced Raleigh federal crimes attorneys who understand the sentencing process is crucial. A federal sentencing hearing will determine how much time you may or may not spend in federal prison. The sentencing guidelines will be discussed with the probation office and the U.S. Attorneys Office leading up to this hearing. The guidelines are often followed by the judge, but they are suggested guidelines, not mandatory guidelines. There are ways to argue for a sentence below the suggested guidelines by focusing on your prior history, your medical concerns, any mental health issues that may have been at play, and any assistance and cooperation that you may have provided throughout the case. There are also factors written into the federal sentencing laws that could be applied to your case. If your lawyer isn’t experienced in federal sentencing, he or she could miss factors that may result in a lower sentence.
